    SES permit

    A sanitary and epidemiological conclusion is a document of a standardized form that certifies the compliance of the object of state sanitary and epidemiological examination with the medical safety requirements for human health and life, is approved by the responsible chief state sanitary doctor (or his deputy) and is binding on the owner of the object of examination.

    Depending on the object of examination, sanitary and epidemiological conclusions can be divided into three groups:

    • sanitary and epidemiological conclusion for products, goods, materials, etc. (list of products that are not subject to examination and obtaining a SES conclusion- Sanitary and Epidemiological Conclusion No. 05.03.02-03/61000 of 28.12.2005)
    • sanitary and epidemiological permit of the SES for technical specifications (TS);
    • sanitary and epidemiological conclusion on the type of activity (production, trade, catering, etc.).

    In 2002, the Law of Ukraine No. 4004-XII "On Ensuring Sanitary and Epidemiological Welfare of the Population" was significantly amended, in particular, the requirement to obtain such a permit for commissioning of premises and commencement of work was canceled. But despite the changes, the SES sometimes abuses its powers by interpreting the law in its favor (Article 15 of the Law). The statutory requirement to obtain an approval does not oblige an entrepreneur to obtain a permit to start work - the company may start its activities in premises that have already been put into operation.

    The SES has the right to require approval for commissioning only new or reconstructed premises - it is unlawful to require a permit for any premises that are not new or reconstructed. Of course, this does not apply to special premises for the production of food products, the requirements for which are justifiably much stricter, as it is a matter of human life and health safety.

    To obtain the SES permit, the following documents must be submitted

    • an application in the form of a template;
    • company details;
    • product samples;
    • title documents;
    • contracts;
    • issued certificates of quality, hygiene and safety (in case of origin of goods from abroad - the country of origin);
    • description of the goods;
    • power of attorney.

    Sanitary and epidemiological examination involves not only the issuance of conclusions and quality certificates, but also the entry of information into a special SES register.  The SES permit is issued for a period of 1 to 5 years.

    You always have the right to appeal against the unlawful actions of the SES authority or an official regarding the requirements for certain permits to the court or administratively to a higher chief state sanitary doctor. Unlawful interference and obstruction of business entities by public authorities and their officials is expressly prohibited (Article 19 of the Commercial Code).
