Provisions on confidential information
Many non-governmental organizations have a declaration in their charter that all information that has been or will be received by their members is confidential.
Confidential information is information about an individual, as well as information to which access is restricted to an individual or legal entity, except for public authorities. Confidential information may be disseminated at the request (consent) of the relevant person in the manner determined by him/her in accordance with the conditions stipulated by him/her, as well as in other cases determined by law. (Article 21 of the Law of Ukraine "On Information")
However, it is the existence of a provision on confidential information, which is familiarized with the interested parties, that will ensure proper protection of your data. Without such a provision, employees and members of the organization are unlikely to bear any responsibility for disclosing information they have become aware of about a particular legal entity.
To develop a confidential information policy, we need the following information
- a list of information that is confidential;
- the desired procedure for access to this information by members and employees;
