Certificate of bankruptcy
confirms that there is no bankruptcy case against a legal entity or individual entrepreneur (that it is not in bankruptcy proceedings and has not been declared bankrupt) at the time of its issuance. As a document certifying the financial condition, it is required:
- most often - to participate in a tender, bidding, competitions, etc,
- to enter into a transaction (at the request of the counterparty),
- in court when considering a case.
Legal framework:
According to the Law of Ukraine "On Public Procurement", the fact of bankruptcy proceedings is a reason for refusal to register for a tender, which is why a certificate is required. It is formed on the basis of the data from the Unified Register (Unified Database) of Data on Enterprises Subject to Bankruptcy Proceedings. The procedure for issuing it is regulated by Order of the Ministry of Justice No. 3305/5 dated 11.11.2011.
It is issued by the Ministry of Justice (formerly the Bankruptcy Agency). The deadlines have also been changed - from 30 business days to 10 from the date of receipt of the request. The certificate contains more information than before: the form of ownership and the main type of activity according to the KVED.

Package of required documents:
- application-request for issuance of a bankruptcy certificate on the applicant's letterhead (for sole proprietorships - if any), with signature and seal (if any, legal grounds for obtaining do not need to be indicated), EDRPOU code (identification code of the sole proprietor); full name of the legal entity (full name of the sole proprietor); legal address of the legal entity (place of registration of the sole proprietorship); bank institution where the current account is opened; copy of the extract or certificate of state registration of the legal entity or sole proprietorship
