Despite the unification of the registration procedure and the unification of all functions in the "single window" format and the person of the state registrar, which are now actively involved in the practice of registering legal entities and individual entrepreneurs (Law of Ukraine "On State Registration of Legal Entities and Individual Entrepreneurs" of 15.05.2003 No. 755-IV and Order of the Ministry of Justice of 19.08.2011 No. 2010/5 "On Approval of the Procedure for Submission and Circulation of Electronic Documents to the State Registrar"), which, albeit slowly, are really bringing Ukraine closer to European standards in terms of loyalty, speaking of other types of enterprises, one should realize their fundamental role in modern society as a whole. After all, we are talking about factors that affect the ability of people to unite, exercise self-government, set and achieve socially significant goals, and not just conduct business and make a profit. The very definition of civil society explicitly states that it is a sphere of spontaneous self-organization and self-government of free individuals on the basis of voluntarily formed associations of citizens, protected by law from direct interference and regulation by the state. Thus, the increase in the number and fundamental changes in the quality of activities of various public foundations, youth and civic organizations, cooperatives, trade unions and other legal entities of civil society directly indicate the level of its formation in modern Ukraine.
Of course, depending on the specifics of activities and statutory tasks inherent in one or another type of such organizations, the procedure for their state registration also undergoes certain changes, and all the features individualizing this process are spelled out in special legal acts, such as
- for religious organizations - the Law of Ukraine "On Freedom of Conscience and Religious Organizations" of 23.04.1991, № 987-XII;
- for organizations of disabled people - the basic Law of Ukraine "On Public Associations" of 22.03.2012, No. 4572-VI, the Law of Ukraine "On the Fundamentals of Social Protection of Disabled People in Ukraine" of 21.03.1991, No. 875-XII;
- for condominiums (condominiums) - the Law of Ukraine "On Privatization of the State Housing Fund" of June 19, 1992, No. 2482-XII (as amended on November 09, 2011);
- For trade unions and their associations - the Law of Ukraine "On Trade Unions, their Rights and Guarantees of Activity" of September 15, 1999, No. 1045-XIV;
- for political parties - the Law of Ukraine "On Political Parties in Ukraine" No. 2365-III dated April 05, 2001, etc.
Further optimization of the legislation on taxation of non-profit organizations and reduction of the grounds for both state interference and political bias will provide even more opportunities for growth of the inexhaustible potential of the "third sector", which is public and non-profit organizations, increase of their role in the development of social orientation of the economy and activation of self-government of society, which has long been an urgent global need.
