Opening and registering a code for a motor vehicle business

In today's business practice, vehicles are indispensable. To date, to register a vehicle with the traffic police as a legal entity, you do not need to open a vehicle code - it coincides with the company's EDRPOU number. But in order to put one or more vehicles (cars, trucks, buses - it doesn't matter) on the company's balance sheet,

there are two ways: 

• register a motor carrier company;
• open the code of the vehicle fleet.

Obviously, if you do not intend to provide automotive services, the second alternative is more suitable for you.

The ATP code (code of a motor vehicle company) is a certificate of assignment of a code by an enterprise, which is issued when registering from one vehicle to 15 vehicles per legal entity. The legal basis for these registration actions is the Resolution of the Cabinet of Ministers of Ukraine No. 1388 dated 07.09.1998 "Procedure for State Registration (Re-registration), Deregistration of Cars, Buses, and Self-Propelled Machines Constructed on the Chassis of Cars, Motorcycles of All Types, Brands and Models, Trailers, Semi-Trailers, Motorized Wheelchairs, Other Equivalent Vehicles and Mopeds".

If you have more than 15 vehicles, you will have to conclude an agreement with an existing vehicle service station for parking, repair and technical control, unless you open a vehicle service station yourself. Of course, there are strict requirements when opening a motor carrier service station: you need to have a motor carrier service station manager and a road safety specialist on staff who must keep a log of road safety instructions. It is also necessary to conclude an agreement with a doctor for medical examination of drivers and have a separate fenced parking area. According to Art. 35 of the Law of Ukraine "On Road Traffic", vehicles older than 2 years used for commercial purposes are subject to mandatory technical control, so the contract should specify the terms of maintenance and repair of the car. Starting a motor vehicle business is not tied not only to the district, but even to the city where your company is registered. All payments (registration fee and tax to the Pension Fund) are made at the place of registration of the legal entity.

Documents for obtaining an ATP code:

• an extract from the EDRPOU (certificate of state registration of the enterprise) - a copy certified by the signature of the head and the seal of the legal entity;
• certificate of VAT (single tax) payer;
• charter of the enterprise; 
• an order appointing a responsible person (with a special technical education);
• agreement with the motor vehicle transport company.
