A trade union is a non-profit organization, an association of citizens based on common interests in the field of professional activity or education. The Ministry of Justice is responsible for registering all-Ukrainian trade unions in the country, and regional departments of justice for other trade unions.

Peculiarities of establishing a trade union
Trade unions in Ukraine can be registered
- with legalization without the status of a legal entity;
- with the establishment of a legal entity.
The status of a legal entity expands the scope for the organization's activities and allows it to:
- conclude collective bargaining agreements;
- participate in negotiations;
- to authorize the dismissal of employees at the enterprise;
- monitor compliance with labor protection standards.
Ukrainian citizens (at least three persons) can form trade unions, but foreigners and stateless persons can also participate in them. Trade unions may unite into associations and join international organizations.
The procedure for registering a trade union
- Holding a constituent assembly, making a decision to establish an association.
- Drafting and approval of the charter.
- Decision to join a local or regional primary trade union organization, notifying them (or the central body of trade unions) of the establishment of the association.
- Sending documents to the justice authority (within 60 days from the date of the decision).
- Registration of the formation (within 1 month).
List of documents to be submitted to the justice authority
- Application.
- Minutes of the constituent assembly.
- Charter (2 copies).
- Registration card in the form No. 1 (for registration of a legal entity).
- Information about the elective bodies of the formation, about the head who represents the organization without a power of attorney in interaction with other bodies, contact details.
When submitting documents through a representative, a notarized power of attorney is required.
The registration authority makes a decision on the establishment of a trade union and issues a corresponding decree, enters information about the trade union into the Register of Public Formations, and is responsible for registering the legal entity in the Unified State Register.
Documents for a labor union

- a certificate of legalization of the trade union;
- an extract from the Unified State Register.
