It is no exaggeration to say that among all civic organizations, it is the civic organizations of disabled people that perform the most important functions, because, in addition to providing social services, representing and protecting their interests and rights, these organizations create enterprises that employ disabled people, and thus promote active socialization, which is so necessary for people with disabilities. Disabled people are largely deprived of the opportunity to assert their rights and protect their interests, especially in our country, and therefore the creation of organizations for them seems particularly appropriate.
Out of the total number of civic associations in Ukraine, which is about 20,000, more than a thousand of them focus on the problems of disabled people. The Ministry of Justice alone registered 38 organizations of disabled people between 1990 and 2002. Through these organizations, domestic business structures and international donors provide funds for social projects for disabled people in Ukraine. The activities of organizations of disabled people are regulated, in addition to the basic Law of Ukraine "On Public Associations" of 22.03.2012 No. 4572-VI, by the Law of Ukraine "On the Fundamentals of Social Protection of Disabled People in Ukraine" of 21.03.1991 No. 875-XII, which has undergone many changes over the years.
An organization of disabled people is a public association that brings together people with disabilities, often with a common disability, to protect and represent their rights and interests in society.
The members of an organization may be: persons with disabilities; legal representatives of a disabled person; other persons who contribute to the organization's activities and provide assistance to disabled persons.
Establishment of an association of disabled persons is similar in procedure to the registration of any public organization.
Documents for registration:
- an application signed by at least three founders or their authorized representatives (the sample is approved by the order of the Ministry of Justice of 14.12.2012 No. 1842/5)
- registration card for state registration of a legal entity in the form-1 (approved by the Order of the Ministry of Justice of Ukraine No. 3178/5 dated 14.10.2011);
- charter (regulations) in two copies;
- minutes of the constituent congress (conference) or general meeting that adopted the charter (regulations);
- information on the composition of the management of the central statutory bodies (including the PFB);
- data on the presence of local branches, confirmed by the minutes of conferences (meetings);
- information about the founders (for citizens - with full name);
- a document confirming the location (letter of guarantee from the owner of the premises, lease agreement, etc;)
- a document confirming payment of the registration fee.
The registration fee for NGOs of disabled persons and persons affected by the Chornobyl accident has been reduced by 50%.
In order to obtain the status of a non-profit organization and further preferential taxation, associations of disabled persons must additionally register with the State Tax Authorities at their location.
