    In the context of active establishment of partnership relations with the EU countries and, in general, with Ukraine's entry into the international market, it is increasingly necessary to use documents issued abroad in our work and provide our partners with domestic ones.     The administrative service of affixing an apostille to these documents was approved by the Order of the State Registration Service of Ukraine No. 386 dated 27.06.2013.

    As you know, an apostille is a special stamp that certifies the authenticity of a person's signature, seal or stamp on a document issued in any of the states party to the 1961 Hague Convention (which abolished the need to legalize foreign official papers). Ukraine joined the Convention in 2003.

    Depending on the type of document, different government agencies are responsible for apostillization: The Ministry of Foreign Affairs, the Ministry of Justice, the Ministry of Education and Science, and the State Registration Service. Obviously, it is the latter that will help us to apostille an extract or an extract from the EDRPOU, since its competence includes the registration of enterprises and the maintenance of their State Register.

    All you need to do is provide the documents:

    • A completed application form in the prescribed form for apostillization;
    • An extract or excerpt from the Unified State Register;
    • Receipt of payment of the state fee or a document exempting from it (for applicants with privileges). 

    The registrar is obliged to check the condition of the documents and the possibility of affixing an apostille - taking into account the country to which the documents are to be submitted - an extract or an extract from the USREOU. 

    Legal grounds for refusal to apostille:

    • The document is intended to be used in a country that has not acceded to the Hague Convention or has reservations regarding Ukraine (for example, Germany lifted them only in 2010);
    • Its text is damaged, illegible, or has corrections (often happens in cases of fax receipt);
    • Signature in violation of the requirements, impossibility to obtain samples of the respective signatures, stamps or seals. 

    The usual term for affixing an apostille is up to 3 days.

    In more complicated cases (if it is necessary to obtain a signature sample, stamp and/or seal impression, etc. additional information or clarification) - can be extended up to 20.
