    The legal basis for the use of electronic digital signatures (EDS) is the Law of Ukraine “On electronic documents and electronic document management” No. 851-IV of 22.05. 2003 and the Law of Ukraine "On electronic digital signature" No. 852-IV of 05.22.2003, which entered into force at the beginning of 2004. It was they who made it possible to execute legally significant actions without the obligatory presence of paper information carriers. It is clear that their adoption was caused by the urgent need to improve the document flow in the state and bring it to a qualitatively new level, worthy of the 21st century.

    An electronic digital signature is a type of electronic signature obtained as a result of cryptographic transformation of a set of electronic data that is attached to or logically connected to this set and makes it possible to confirm its integrity and identify the signatory. An electronic digital signature is imposed using a private key, verified using a public key and is a complete analogue of a real handwritten signature, which gives the document legal force with it.

    The legal force of an electronic document signed by an EDS is equivalent to the legal force of a paper document with a handwritten signature of a legally capable person and sealed. EDS is used in business correspondence between subjects of all forms of business and individuals and greatly simplifies the process of submitting the necessary reports to the controlling state structures: the Pension Fund, the State Central Office, the Statistics Department and the Tax Service. The presence of an EDS does not allow the person who signed the document to refuse the obligations arising from its signing.     Who issues the EDS?

    Creates, issues and installs digital signature certificates for legal entities and individuals for electronic document management Accredited Key Certification Center "Ukraine" (AKCC). Its automated system is designed to process data received from customers, generate certificates and public EDS keys for customers, maintain a database, save, distribute, block, restore and revoke EDS certificates, generate lists of revoked certificates. The activities of the Center are regulated by the above laws and regulations of the Cabinet of Ministers of Ukraine, which regulate the conduct of electronic document management. AKCC "Ukraine" is accredited as the Central certifying body for servicing enhanced certificates in Ukraine and has all the licenses and certificates necessary for its activities.

    EDS Reliability

    The funds used to work with EDS are examined by the State Service for Special Communications and Information Protection of Ukraine. Thanks to reliable cryptographic algorithms, confidentiality of information is ensured, which provides for the impossibility of access to it by any person who does not have a secret key.

    Documents required to obtain an EDS:

    • an agreement on the provision of electronic signature services - in 2 copies or a card of accession to the electronic agreement on the provision of electronic signature services (in paper form) - in 1 copy;
    • a copy of a document confirming state registration (a copy of a state registration certificate, a copy of an extract or extract from the USR);
    • a copy of the certificate of registration of a VAT payer (if the legal entity is a VAT payer);
    • copies of documents on the appointment of each person for whose signature a certificate is acquired (manager, chief accountant, employee): a copy of the order on their appointment or a copy of the minutes of the meeting of the general meeting;
    • copies of the passports of these persons certified by their owners;
    • copies of certificates of assignment of identification numbers, certified by their owners;
    • applications for the formation of enhanced EDS certificates for each person, for whose signature the certificate is purchased, generated in the MEDoc system, in electronic format on magnetic media and in paper form, certified by the owners;
    • power of attorney for our employee who will receive an EDS;
    • certificate of completion confirming payment for certificates.

    We ourselves will form in the electronic document management system "M.E.Doc" on the basis of the data provided by you, the application according to the instructions, the requirements of which are contained in the order of the Ministry of Justice and other government agencies involved in the protection of information, as well as make all the necessary payments. As a result of these actions, you will receive from us an EDS and instructions for its use in electronic document flow.

    In accordance with the order of the Administration of the State Service for Special Communications and Information Protection of Ukraine dated December 18, 2012 No. 739 "On approving the requirements for the formats of cryptographic messages", from the beginning of 2014 an additional certificate should be used - an encryption certificate (replacing the seal in the electronic version), therefore from 01.01.2014 ACCC “Ukraine” issues additional certificates. EDS certificates issued before this date can be used for encryption until their expiration date, and after its expiration, additional encryption certificates are not required. If the encryption certificate is generated with the same details as the EDS certificate, you must submit a standard set of documents and an application for an encryption certificate. Applications for an encryption certificate should be formed and filled in the same way as applications for EDS certificates (when generating them, you should pay attention to field 2.1 "The key is used as").

    Documents signed with EDS can be transferred to the destination in a matter of seconds, the location of the counterparty, distance or time of day no longer matter. Using EDS, you will receive additional protection of important information, fundamentally reduce the time for document circulation and free yourself from unnecessary hassle with the expense processes of archiving paper documents. EDS is simply indispensable in the daily work of the chief accountant when registering tax invoices in electronic form.
