CE marking for Ukrainian manufacturers

What a "European certificate of conformity" really is

The phrase usually refers to three things: the CE mark on the product, the EU declaration of conformity signed by the manufacturer, and the technical documentation. A notified body certificate (such as an EU-type examination certificate) is issued only where the legislation requires third-party involvement.

Which products need CE

• electrical and electronic equipment, radio equipment;
• machinery and lifts;
• personal protective equipment;
• construction products;
• toys, drones, pyrotechnics, recreational craft;
• medical devices, including diagnostic devices.

Food, cosmetics and chemicals fall under separate EU rules and do not carry CE marking.

Six steps to CE marking

1. Identify all applicable EU requirements and harmonised standards.
2. Decide whether self-assessment is enough or a notified body is needed; notified bodies are listed in the European Commission's NANDO database.
3. Verify conformity through testing in accredited laboratories whose reports the chosen body accepts.
4. Prepare the technical documentation: description, drawings, risk analysis, test reports, instructions.
5. Draw up and sign the EU declaration of conformity.
6. Affix the CE mark according to the rules on size and placement.

Who is responsible in the EU

For certain products, Article 4 of Regulation (EU) 2019/1020, applicable since 16 July 2021, requires an economic operator established in the EU: the manufacturer, an importer, an authorised representative or a fulfilment service provider. The manufacturer keeps technical documentation for at least 10 years after the product is placed on the market.

CE and the Ukrainian market

Ukraine has its own technical regulations based on EU legislation and a national conformity mark (Articles 29 and 30 of the Law of Ukraine on Technical Regulations and Conformity Assessment). Products sold in Ukraine go through Ukrainian conformity assessment; if you sell in both markets, we plan testing so that results can serve both procedures where the bodies accept them.
